When you become a Member of REG44 (“Member” meaning either a non-subscribing person using the services described in these terms and conditions, or a person / organisation paying a subscription to REG44 for the services described in these terms and conditions), you agree to abide by these terms and conditions. These terms and conditions may be varied by REG44 from time to time and it is your responsibility as a Member or visitor to keep up to date with the terms and conditions. No other terms and conditions shall apply or have any effect on the applicability of these terms and conditions which shall govern to the exclusion of all other terms and conditions.

It is strictly forbidden to retrieve data from this site for purposes other than allocating an independent Regulation 44 visitor to undertake a Regulation 44 visit (Children’s Home (England) Regulations 2015) Registered Children’s Home Providers must not save any data retrieved for future use and must refrain for retrieving and storing bulk data.

Access to any information contained on this site is strictly in accordance with all of the following:Local Authorities and Registered Children’s Home Providers who become members of REG44 agree that upon becoming a member, they will access the REG44 database for the sole purpose of searching for an independent Regulation 44 visitor for a Regulation 44 visit. Where a Regulation 44 visitor is selected specifically for a Regulation 44 visit, Local Authority and Registered Children’s Home Provider members agree they are not permitted under any circumstances, to store any data about any independent Regulation 44 visitor for future use.

The information contained in this web site does not represent any statement by REG44 as to the suitability or otherwise of the independent Regulation 44 visitors, Local Authorities or Registered Children’s Home Providers. Nor does REG44 accept any responsibility or liability whatsoever for the quality, suitability or timeliness of the independent Regulation 44 visitor’s work. It is entirely the responsibility of the commissioning organisation to ensure that the independent Regulation 44 visitor, their terms and conditions of engagement or the outcome of their work are appropriate and meet the requirements expected.

Overview

REG44 provides an online solution / introduction service for independent Regulation 44 visitors and potential Clients / Local Authorities and other registered children’s home providers who are in need of their services. To achieve this, REG44 posts the information provided by members and provides members with a search and contact facility. Each member understands and agrees that REG44 has no involvement concerning matching or recommending members to other members as well as understanding that REG44 has no obligation to provide members with suitable links and cannot and does not give any guarantee as to suitability of links. A link shall be considered an interaction between a commissioning organisation such as a Local Authority or registered children’s home provider (commissioning party) and an independent Regulation 44 Visitor (provider party) and this shall be satisfied by REG44 by providing the facility for the commissioning party to communicate with the provider party.

Local Authorities and Registered Children’s Home Providers must not divulge information about an independent Regulation 44 Visitor without first seeking permission from the independent Regulation 44. Details obtained by Local Authorities and Registered Children’s Home Providers from REG44 about independent Regulation 44 Visitors must only be used for formal Regulation 44 Visitor work under the Children’s Home (England) Regulations 2015.

Terminology

The following terminology applies to these Terms and Conditions, Privacy Statement and Disclaimer Notice and any or all Agreements: “Client”, ‘Organisation’, Commissioning Organisation’, Local Authority, Registered Children’s Home Provider “You”, ‘Users’, Registered Users’ and “Your” refers to you, the person accessing this website and accepting the Company’s terms and conditions. “The Company”, “Ourselves”, “We” and “Us”, refers to our Company, RRC (RRCONSULTANCY) LTD. “Party”, “Parties”, or “Us”, refers to both the Client and ourselves, or either the Client or ourselves. The term ‘’register’, ’national register’ and ‘database’ all refer to the database that holds information about all registered members. All terms refer to the offer, acceptance and consideration of payment necessary to undertake the process of our assistance to the Client in the most appropriate manner, whether by formal meetings of a fixed duration, or any other means, for the express purpose of meeting the Client’s needs in respect of provision of the Company’s stated services/products, in accordance with and subject to, prevailing English Law. Any use of the above terminology or other words in the singular, plural, capitalisation and/or he/she or they, are taken as interchangeable and therefore as referring to same.

Accuracy of Information

Although we make every attempt to ensure that it is correct and accurate, REG44 cannot guarantee the accuracy of the information on this Service, and are not liable for any problems or losses arising from errors in the content.

In using the Services provided by REG44, you acknowledge that REG44 is not acting as a contractor or agent and is not responsible for any work done. It is the responsibility of the Client / Local Authority to select a suitable independent Regulation 44 Visitor and to negotiate the terms for any work that they undertake, and REG44 will not be involved or held liable for any Service Agreement between the Client / Local Authority/ Registered Children’s Home Provider and independent Regulation 44 Visitor.

We recommend that any Client / Local Authority / Registered Children’s Home Provider before entering into a Service Agreement with any independent Regulation 44 Visitor, obtains confirmation of insurance cover, guarantees, qualifications, DBS/CRB checks and any other necessary document necessary for the work being commissioned. REG44 does not vet or recommend any independent Regulation 44 visitor and it is up to the client to make it’s own assessment and decision on whether to commission a registered independent Regulation 44 Visitor. REG44 will not be held liable from any losses resulting from commissioning an independent Regulation 44 Visitor from this site.

Membership

A membership charge may be payable for membership of REG44. Rates are subject to change and you are encouraged to visit the membership rates section of this site. Registered users may cancel their account at any time without giving any notice. Refunds are not made for any cancelled membership accounts.

Independent Regulation 44 Visitors: As a subscribing member, you will receive all the benefits and features available to members and in addition you will receive the following benefits for subscribing members which includes your profile being featured on the REG44 national database.

Please see our membership rates for a description of the current cost of becoming a subscribing member of REG44. REG44 may change the subscription fees at any time, which for existing subscribing members will take effect on expiry of their then current period of subscription, but otherwise will be immediately effective. REG44 will endeavour to give subscribing members reasonable notice of any change in subscription fees before implementing any change.

REG44 may immediately terminate your membership without warning if you breach any of these terms and conditions (as may be amended from time to time), if REG44 receives any complaint about your conduct, or if you act in a manner deemed by REG44 to be inappropriate. You may terminate your membership at any time, for any reason, effective upon receipt by us, by emailing a notice of termination to info@regulation44.local However, you acknowledge and agree that you will not be entitled to any refund of any membership fees paid to REG44.

Security

You are responsible for ensuring that you keep your user name and password confidential.

Commercial use by members

Members may not use the services offered through this website or the website itself for illegal and/or unauthorised uses, including collecting usernames and/or email addresses of Members by electronic or other means for the purpose of sending unsolicited email and unauthorised framing of or linking to the website. Any such action will be investigated, and appropriate legal action may be taken, including without limitation, civil, criminal, and injunctive remedies.

Searching REG44 Database

Local Authorities / Registered Children’s Home Providers who become members of REG44 agree on becoming a member that they will access the REG44 database to search for an independent Regulation 44 Visitor for Regulation 44 visits. Local Authorities / Registered Children’s Home Providers agree not to store any data about an individual independent Regulation 44 Visitor that is not allocated to a Regulation 44 visit for future use.

Member Profiles

All contents of member profiles are subject to our approval. Approval is based solely on the information provided by members (Regulation 44 Visitors and Registered Children’s Home Providers). REG44 does not verify the information provided by members and encourages all parties to complete their own due diligence before engaging with and agreeing services from each other. We reserve the right in our sole discretion to reject or remove any member profile at any time if we believe in good faith it fails to conform to applicable laws and regulations, our policies or the public interest. In addition, we may reject any URL link or personal contact details embodied within any profile.

REG44 may deactivate the accounts of members who have not used the service for a period of eighteen months or more (as calculated by the date of last connection / login to the service).

Privacy Statement

We are committed to protecting your privacy. Authorised employees within the company on a need to know basis only use any information collected from individual users. We constantly review our systems and data to ensure the best possible service to our service users. Parliament has created specific offences for unauthorised actions against computer systems and data. We will investigate any such actions with a view to prosecuting and/or taking civil proceedings to recover damages against those responsible.

Confidentiality

Client records are regarded as confidential and therefore will not be divulged to any third party, other than registered users of this site and if legally required to do so to the appropriate authorities. Clients have the right to request sight of, and copies of any and all Client Records we keep, on the proviso that we are given reasonable notice of such a request. Clients are requested to retain copies of any literature issued in relation to the provision of our services. Where appropriate, we shall issue Client’s with appropriate written information, handouts or copies of records as part of an agreed contract, for the benefit of both parties.

We will not sell, share, or rent your personal information to any third party. Any emails sent by this Company will only be in connection with the provision of agreed services or related services provided by the Company.

Security and Infrastructure

REG44 uses Knack database applications for the national register. Knack services are powered by Amazon Web Services (AWS).

Knack complies with the U.S.-EU Safe Harbor Framework and the U.S.-Swiss Safe Harbor Framework as set forth by the U.S. Department of Commerce regarding the collection, use, and retention of personal information from European Union member countries and Switzerland.

Knack has certified that it adheres to the Safe Harbor Privacy Principles of notice, choice, onward transfer, security, data integrity, access, and enforcement.

Our Responsibilities

We will respect your information and will comply with all applicable data protection legislation in force in England and Wales. At times we may be required to disclose your personal information to contracted third party suppliers where this is necessary to fulfill our obligations to you. Such third party suppliers shall only be entitled to use your personal information to fulfill its obligations to REG44. By becoming a Member of REG44 you are consenting to REG44 using your personal information to provide the services and provide you with information about products and/or services offered by REG44 or RRC which may be of interest to you. In order to maintain the integrity of this website, we reserve the right to forward your contact details to any regulatory authorities when requested to do so, including the police.

Your Responsibility

You are responsible for any information that you give which must be specific and relate to your current needs. You agree that you are solely responsible for ensuring the suitability of an independent Regulation 44 visitor for the role you are commissioning them for. It is recommended that you undertake a rigorous face to face interview, take steps to verify previous employment and qualifications, take up character and work references, undertake a Criminal Records Disclosure check and other actions you consider necessary to confirm the integrity of an independent Regulation 44 visitor. You also agree that age, gender or ethnicity data or any other such information provided by an independent Regulation visitor will not be used in any employment-related decision you make. However, this is your responsibility and REG44 accepts no responsibility or liability for the commissioning of an independent Regulation 44 visitor.

Use by agencies

REG44 is not specifically set up to cater for agencies, therefore does not encourage the use of the service by agencies. However, if an agency wishes to become a member of REG44 it should contact REG44 to discuss its needs further.

Intellectual Property

The Company owns all the intellectual property rights relating to the site, including the designs, text, database, graphics and layouts, and you agree not use or copy any part thereof without our express permission.

Disclaimer Exclusions and Limitations

The information on this web site is provided on an “as is” basis. To the fullest extent permitted by law, this Company:

  • excludes all representations and warranties relating to this website and its contents or which is or may be provided by any affiliates or any other third party, including in relation to any inaccuracies or omissions in this website and/or the Company’s literature; and

Termination of Agreements / User Registration

If you register to use this site you can terminate / cancel your user registration at any time without notice. The company reserves the right to cancel any registration without giving notice.

Both the Client and ourselves have the right to terminate any Services Agreement / User Registration for any reason, including the ending of services that are already underway.

Availability

Unless otherwise stated, the services featured on this website are only available within the United Kingdom, or in relation to postings from the United Kingdom. Redistribution or republication of any part of this site or its content is prohibited, including such by framing or other similar or any other means, without the express written consent of the Company. The Company does not warrant that the service from this site will be uninterrupted, timely or error free, although it is provided to the best ability. Force Majeure

Any Party affected by such event shall forthwith inform the other Party of the same and shall use all reasonable endeavours to comply with the terms and conditions of any Agreement contained herein.

Waiver

Failure of either Party to insist upon strict performance of any provision of this or any Agreement or the failure of either Party to exercise any right or remedy to which it, he or they are entitled hereunder shall not constitute a waiver thereof and shall not cause a diminution of the obligations under this or any Agreement. No waiver of any of the provisions of this or any Agreement shall be effective unless it is expressly stated to be such and signed by both Parties.

General The laws of England and Wales govern these terms and conditions. By accessing this website you consent to these terms and conditions and to the exclusive jurisdiction of the English courts in all disputes arising out of such access.
